Comprehensive Search for Environmental Liens Filed Against Properties

An environmental lien is a charge, security, or encumbrance on a property's title to secure payment of cost or debt arising from response actions, cleanup, or other remediation of hazardous substances or petroleum products. Under the EPA's new "All Appropriate Inquiry" regulations, an environmental lien search is one of the primary steps needed to satisfy the requirements.

Using our vast, nationwide network of county-level abstract researchers, Banks will check records at the appropriate County Recorder’s Office for any environmental liens filed from 1985 to present.  Banks will also search for any deed restrictions that may be of an environmental concern and/or ‘Activity or Use Limitations’ or AUL’s.  The client will also be provided with the most current vesting deed on the property along with being informed whether their site is located in what is considered a “Super Lien State.”
